In New York, almost all Workers’ Compensation hearings are now conducted virtually. This allows you to attend your hearing from the comfort of your home or office using a smartphone, tablet, or computer. At Troy & Eaton, LLP, we will be with you every step of the way, even if we are in different locations.
You should appear for your hearing if:
You received a Hearing Notice: The Board sends these via mail or through your digital file.
Your Attorney advises you to attend: We will often contact you to discuss the specific goals of an upcoming hearing.
Testimony is required: If you are scheduled to testify about your accident or your medical condition, your presence is mandatory.
Pro Tip: You should log in to the "Virtual Waiting Room" at least 20 minutes before your scheduled start time. Be patient! The Judge may have multiple cases scheduled for the same time. Your case may not be called at the exact time on your hearing notice.
The New York State Workers’ Compensation Board has strict rules regarding video.
When Video MUST be on: If you are testifying, you must have your camera on with your face fully visible. The Judge needs to see you to assess your testimony.
Representation: As your attorneys, we are also required to be on video.
General Appearances: Even if you aren't testifying, the Board strongly encourages video participation to ensure clear communication between you, the Judge, and the insurance carrier’s representative.
Step 1: Get the App
If you are using a mobile device (phone or tablet), you must download the Webex (Business) app.
Step 2: Check-In
Go to the official NYS Virtual Hearing Center link below and enter the Virtual Hearing ID found at the top of your hearing notice.
Step 3: Wait for the Chime
Once you check in, you will stay in a "Virtual Waiting Room." You can use other apps on your phone while you wait, but keep your volume up. You will receive a text message or a "chime" when the Judge is ready to start your case.
